TERMS & CONDITIONS

These Terms & Conditions (“Agreement”) govern your access to and use of:

(collectively, the “Website”).

The Website offers Lightroom presets, ACR presets, Photoshop actions, educational materials, guides, downloads, subscription services, and related digital products (collectively, the “Products”).

This Agreement forms a legally binding contract between you and Red Leaf Studios Inc. (“Red Leaf,” “we,” “us,” or “our”).

By accessing the Website or purchasing or using any Product, you agree to be bound by this Agreement.

If you do not agree, you must not use the Website or purchase Products.

1. ELIGIBILITY

You must be the age of majority in your jurisdiction to enter this Agreement.
If you are entering into this Agreement on behalf of a company or entity, you represent that you have authority to bind that entity.

2. LICENSE GRANT

Subject to your compliance with this Agreement and payment of applicable fees, Red Leaf grants you a:

  • Limited

  • Non-exclusive

  • Non-transferable

  • Non-sublicensable

  • Revocable license

to download and use the purchased Product for lawful business or personal use.

Unless otherwise specified:

  • Each Product purchase includes a five (5) seat license.

  • A “seat” means one natural person or device.

  • Additional seats require purchase.

You may not:

  • Resell, redistribute, sublicense, share, or transfer Products.

  • Modify Products for resale.

  • Reverse engineer or attempt to extract source components.

  • Upload Products to file-sharing services or public repositories.

The license survives subscription cancellation for Products properly acquired, unless terminated due to breach.

3. INTELLECTUAL PROPERTY

All Website content and Products are owned by or licensed to Red Leaf and protected by copyright, trademark, and intellectual property laws.

No ownership rights are transferred to you.

Unauthorized use constitutes infringement and may result in legal action.

4. ACCOUNT RESPONSIBILITY

If you create an account:

  • You are responsible for maintaining confidentiality of login credentials.

  • You are responsible for all activity under your account.

  • You must notify us of unauthorized access.

Red Leaf is not liable for losses resulting from unauthorized account use.

5. PAYMENTS & REFUND POLICY

All Product sales are final except:

  • As required by applicable law; or

  • In cases of duplicate purchases of the same Product (subject to transaction fees).

Because Products are digital downloads delivered immediately, no refunds are provided for:

  • Software incompatibility

  • User dissatisfaction

  • Failure to review Product requirements before purchase

Prices are listed in U.S. Dollars unless stated otherwise.

You are responsible for applicable taxes and foreign transaction fees.

6. ARCHIPELAGO QUEST SUBSCRIPTION

6.1 Subscription Overview

Archipelago Quest (“Quest Subscription”) is a recurring subscription service providing access to selected Products and benefits described on the Website.

Subscription benefits may change from time to time at Red Leaf’s discretion.

6.2 License

Quest Subscription includes a five (5) seat license unless otherwise stated.

6.3 Billing & Automatic Renewal

By enrolling, you authorize Red Leaf to charge your selected payment method:

  • On a recurring 3-month or 6-month basis (as selected at signup).

  • On each renewal date unless canceled before renewal.

Renewal terms and pricing are disclosed at checkout.

You may cancel at any time through your account settings. Cancellation prevents future renewals but does not refund prepaid periods.

6.4 Cancellation

Upon cancellation:

  • You retain access through the end of your prepaid billing period.

  • You retain license rights to Products properly downloaded during active subscription.

  • No refunds or prorated credits are provided except as required by law.

6.5 Subscription Discontinuation

Red Leaf may modify or discontinue the Quest Subscription with reasonable notice.

If discontinued, access will continue through the end of any prepaid billing period.

7. MONTHLY CREDIT PROGRAM

Active Quest members receive one (1) monthly credit valued at $38 USD.

Credits:

  • May be redeemed toward eligible preset collections only.

  • May not be redeemed for cash.

  • May not be applied to subscriptions or bundled products unless designated.

  • Are non-transferable.

  • Cannot be combined with other promotions unless stated.

Credits roll over while membership remains active.

If membership terminates, unused credits are forfeited.

Red Leaf reserves the right to modify or discontinue the credit program with reasonable notice.

8. USER CONTENT & REVIEWS

If you submit reviews or forum content:

  • You grant Red Leaf a worldwide, royalty-free, perpetual license to display, reproduce, and distribute such content.

  • You represent that you own or have rights to the content.

Red Leaf may moderate, remove, or decline reviews at its discretion, including content that is:

  • Defamatory

  • Misleading

  • Fraudulent

  • Spam

  • Irrelevant to the Product

Publication of reviews does not constitute endorsement.

9. PROHIBITED USES

You may not use the Website or Products:

  • For unlawful purposes

  • To infringe intellectual property rights

  • To distribute malware

  • To scrape, crawl, or harvest data

  • To circumvent security measures

  • To resell Products

Violation may result in suspension or termination.

10. TERMINATION

Red Leaf may suspend or terminate your access:

  • For breach of this Agreement

  • For misuse of Products

  • For fraudulent activity

Upon termination for breach:

  • Licenses terminate immediately.

  • Access to subscription benefits ceases.

  • Unused credits are forfeited.

Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. DISCLAIMER

The Website and Products are provided “AS IS” and “AS AVAILABLE.”

Red Leaf disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Compatibility with specific hardware or software

Results may vary depending on lighting, camera equipment, exposure, white balance, software version, and editing technique.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Red Leaf’s total aggregate liability arising from this Agreement shall not exceed the total amount paid by you in the twelve (12) months preceding the claim.

Red Leaf shall not be liable for:

  • Indirect or consequential damages

  • Loss of profits

  • Loss of data

  • Business interruption

Any claim must be brought within one (1) year of the event giving rise to the claim.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Red Leaf from claims arising from:

  • Your breach of this Agreement

  • Your misuse of Products

  • Your infringement of third-party rights

Red Leaf will control the defense of any claim subject to indemnification.

14. FORCE MAJEURE

Red Leaf is not liable for delays or failures resulting from causes beyond its reasonable control, including:

  • Natural disasters

  • Cyberattacks

  • Government actions

  • Internet service failures

  • Payment processor outages

15. PRIVACY

Your use of the Website is subject to our Privacy Policy, incorporated by reference.

16. GOVERNING LAW

This Agreement is governed by the laws of the Province of British Columbia and the applicable federal laws of Canada.

The parties submit to the exclusive jurisdiction of the courts of Vancouver, British Columbia.

17. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Red Leaf and supersedes all prior communications.

18. MODIFICATIONS

Red Leaf may update these Terms from time to time. Continued use of the Website constitutes acceptance of the updated Terms.
